The New Normal? Prosecutorial Charging in California after Public Safety Realignment (2014)

An article aiming to examine how prosecutors in california were implementing discretionary power under realignment. Study uses interviews with prosecutors documented in the Voices from the Field: How California Stakeholders View Public Safety Realignment report and a survey questionnaire study of Superior Court Judges to examine AB109 effects on judicial discretion and decision making. Results of study emphasize that charging preferences remained consistent with traditional severity factors and do not reveal alteration under AB 109 however, study highlights uncertainty within responses in regards to choice between straight, split, and probation sentencing.
